Occupancy & Children Policy
This policy explains maximum occupancy rules at Maya Resort Samui and how children are counted for safety, insurance, and licensing compliance.
1. Maximum Occupancy Is Strict
For safety, insurance, and licensing reasons, each room and villa has a strict maximum occupancy. The maximum number of guests allowed cannot be changed by sleeping arrangements.
- Children count as guests for occupancy purposes, even if they share beds with adults
- Sleeping arrangements do not change the maximum occupancy
- Maximum occupancy is based on fire and safety regulations, insurance requirements, and licensed room capacity
- The number of guests at check-in must match the reservation
- If more guests arrive than confirmed, additional charges, an upgrade, or refusal of check-in may apply
2. Children Stay Free, Conditions Apply
Children may stay free of charge only if the total number of guests matches the confirmed reservation and does not exceed the maximum occupancy of the booked villa.
3. Additional Guest Charges
If more guests arrive than confirmed in the reservation (but still within the maximum occupancy), additional charges apply, including for children.
- Additional child fee: 500 THB per child, per night (applies when the child is not included in the confirmed reservation)
- This fee does not include an extra bed
- If an extra bed is required: 300 THB per night, subject to availability
- Baby cots are provided free of charge, subject to availability
- All additional charges cover increased usage of utilities and services (water, electricity, air conditioning, towels, linens, housekeeping, and laundry)
4. Maximum Occupancy by Room Type
- Family Villa: maximum 4 persons
- 2-Bedroom Separated Room Villa: maximum 4 persons
- Garden View Villa: maximum 3 persons
- 2-Bedroom Private Pool Villa: maximum 5 persons
- 3-Bedroom Private Pool Villa: maximum 8 persons
5. If More Guests Arrive Than Confirmed
If additional guests arrive beyond the confirmed reservation details, the resort will apply one of the following options depending on the situation:
- If the total number of guests is within the villa maximum occupancy: applicable additional charges will be added
- If the total number of guests exceeds the villa maximum occupancy: a room upgrade may be required (subject to availability)
- If an upgrade is not possible: check-in may be refused in accordance with safety and insurance regulations
- The resort may request updated guest details before check-in to confirm compliance
- Guests are responsible for ensuring their group size matches the booked accommodation
6. Important Notice
- Extra guest charges are not refundable
- Extra guest charges are not a valid reason for cancellation or refund
- By confirming a reservation, guests agree to comply with this Occupancy & Children Policy
- This policy applies to all bookings, including direct bookings and OTA reservations
- The resort reserves the right to enforce these rules for safety and compliance
